Twitter has filed a lawsuit against Elon Musk, and in response, his legal team claims that Twitter is requesting an unfairly quick trial. Musk’s legal team responds by requesting that the matter be postponed until next year, according to sources.
Twitter has pushed for the trial to start in the middle of September, arguing that it is necessary to move things through quickly because Musk and Twitter’s merger deal has a “presumptive drop-dead date” of October 24. However, Musk’s legal team is requesting that the trial not start until at least February 13th, 2023, as per reports.
Twitter referred to its initial complaint, which it filed on Tuesday, and declined to comment further.
After Musk formally attempted to back out of the $44 billion purchase agreement with the company, Twitter filed a lawsuit against him earlier this week. Twitter board chairman Bret Taylor announced that the firm would sue Musk shortly after Musk announced his intention to shut down the service. On Tuesday, the company filed its lawsuit. Although Musk did tweet on Tuesday, he didn’t answer via the court until Friday.
According to what Musk’s legal team wrote last week, Twitter has not provided him with the information he needs to “conduct an impartial assessment of the incidence of fraudulent or spam accounts on Twitter’s platform.” This is Musk’s main argument for wanting to halt the merger. In the filing on Friday, his team mentioned the bots problem once more. As per the sources, “The primary controversy over fraudulent and spam accounts is crucial to Twitter’s worth. A significant amount of time must be spent on discovery because it is also exceedingly fact- and expert-intensive.”
According to sources, a 90-minute hearing will be held next week on July 19 at 11AM ET to determine the date of the trial.
