Justices DY Chandrachud and Hima Kohli had passed the orders to this effect on Wednesday, although the official verdict has not yet been made public as of now.

Ganguly and Shah had already served one term each at the state and BCCI levels and would have been disqualified under the existing rule. They can now serve an additional term at the BCCI, with the new implementation of the rules.

In 2018, the BCCI adopted a newly drafted constitution, which got finalized post the court’s judgement by Justice Chandrachud, that an office bearer who has held any post for two consecutive terms i.e., 6 years, either at a state association or in the BCCI, or a combined of both, shall not be eligible to contest any further election without completing a cooling-off period of three years.

The cooling-off period is when a person cannot serve in any capacity at both the BCCI and state level.

Moreover, some time ago, Justice Chandrachud also said that once the person had finished a time of 6 years at one place whether state or BCCI, he cannot return to the same for three years. And in case the person had finished 12 years at a stretch, 6 each at state and BCCI, he also could not return for a period of three years to either.
